Noua Lege a Concurentei a intrat in vigoare in septembrie 2012. In acest context, ultimii doi ani au avut o importanta deosebita pentru activitatea Consiliului Concurentei, institutia devenind pe deplin functionala, in urma reorganizarilor realizate in 2012-2013, perioada de reformare a cadrului legislativ din domeniul concurenţei. Am invitat-o pe Viorica Carare, Presedintele Consiliului Concurentei, la un dialog cu privire la cultura concurentiala din Moldova, piata de retail si principalele arii de atentie pentru lanturile de magazine, furnizori, distribuitori si ceilalti actori ce formeaza industriile de retail si FMCG.</p> <p><strong>Care au fost, in linii generale, obiectivele institutiei pe care o conduceti, dupa implementarea noii legislatii, si pana in prezent?</strong><br /> In acesti ultimi ani, ne-am concentrat foarte, foarte mult eforturile catre promovarea si cresterea culturii concurentiale in randul agentilor economici din Republica Moldova. Promovarea culturii concurentiale este un proces complex de educatie a mediului de afaceri si societatii in general, care se manifesta in diverse modalitati avand ca scop preintampinarea si reprimarea incalcarilor legislatiei concurentiale. Consiliul Concurentei acorda o atentie deosebita preintampinarii incalcarilor legislatiei concurentiale. Astfel, pe langa seminarele, mesele rotunde etc., efectuate cu mediul de afaceri, un rol deosebit in procesul preintampinarii revine transparentei procesului decizional a Consiliului Concurentei in special in partea ce tine de sanctionarea pentru incalcarea legislatiei concurentiale. Au fost cel putin 3-4 cazuri cand comportamentul agentilor economici in timpul inspectiilor efectuate de reprezentantii Consiliului Concurentei au fost total neadecvate si in afara legii. In anumite cazuri ni s-a interzis accesul in birouri, inspectorii fiind efectiv dati afara, in alte situatii avocatii au sters date din computer in fata noastra, iar exemplele pot continua. Un caz “special” a fost si acela in care un agent economic a intrerupt cu buna stiinta alimentarea la energie electrica a cladirii pentru a nu avea acces la datele din computer. Noi am transmis si catre media locala informatii cu privire la modul in care agentii economici trebuie sa se comporte in cazul unui control al reprezentantilor Consiliului Concurentei si atunci, incet, incet, acestia au invatat ce anume nu trebuie sa faca. Ce vreau sa subliniez este nevoia de a promova in mediul privat o cultura concurentiala, iar eforturile in aceasta directie nu sunt deloc usoare. Tot in ultimii 2-3 ani, am facut demersuri importante pentru a consolida parteneriate internationale cu autoritatile de concurenta din diferite tari, cum ar fi Romania, Slovacia, Ucraina, Ungaria, Federatia Rusa s.a., scopul fiind preluarea bunelor practici din aceste piete. Particularly in times of financial crisis it is essential to use state resources in a rational and efficient way to ensure that a state economy will be less influenced by external factors. In order to monitor the correct implementation of all the state aid in Republic of Moldova, the Competition Council, with the support of the World Bank, has implemented the Electronic Informational Register of Recording and Monitoring State Aid – <a title="Ajutor de stat" href="http://competition.md" target="_blank">SIRASM</a>. SIRASM contributes to a more efficient way of use of state resources by:</p> <ul> <li>Improving efficient of allocation of public funds</li> <li>Ensuring transparency in the use of public money;</li> <li>Improving the implementation of competition law;</li> <li>Promotion of competition culture;</li> <li>Improving the competitive environment.</li> </ul> <p>SIRASM will help to establish a system of state aid monitoring and – the main task – to implement a monitoring mechanism to assess the impact of state aid on the competition environment. This has led to non-discriminatory treatment of all consumers with the purpose of increasing economic efficiency.<br /> The S.E. „Railways of Moldova” applied discriminatory measures against some of its customers that placed them in an unfavourable situation compared to other undertakings from October 2011 to June 2012, by imposing the international tariff on some of them. While undertakings using rail freight services within the territorial boundaries of the Republic of Moldova had to pay the lower local rate, undertakings that had as one of the points of departure or arrival the Giurgiulesti International Free Port (hereinafter GIFP) – which also makes part of the Republic of Moldova and the other – and any other point of the territory of the Republic of Moldova had to pay the higher international rate.<br /> Success story<br /> This case was initiated following a notification by the Ministry of Economy, that identified a competition issue in the non-transparent application of SE „Railways of Moldova”’s pricing policy for the supplied services – a company with a dominant market position<br /> Thus, given that the activity type of S.E. „Railways of Moldova” is the provision of rail passenger services, cargo, baggage and messengers, the relevant product market was defined as the provision of rail freight services. According to Art. 5 paragraph. (3) of the Railway Code No 30-XV from 17.07.2003, the S.E. „Railways of Moldova” operates throughout the country, including the territory of the GIFP.
